End User License Agreement (EULA)

IMPORTANT NOTICE

By installing, activating, or using the RescuePC Repairs Toolkit ("Software") you confirm that you have read, understand, and agree to be bound by this Agreement. If you do not agree, you must not install or use the Software.

1. Grant of License

1.1 License Grant

• RescuePC Repairs grants you a non-exclusive, non-transferable license to use the Toolkit as delivered.
• You may operate the Software on any compatible Windows system you directly own.
• This license is tied to the physical media or installer that delivered the Software.
• Redistribution is prohibited unless you have written authorization from RescuePC Repairs.
• Copies may only be created for personal backup purposes.

2. Copyright and Ownership

• All intellectual-property rights remain with RescuePC Repairs.
• No ownership stake transfers to you when purchasing access to the Software.
• All rights not expressly granted remain reserved by the Company.

3. Restrictions

3.1 You may not

• Reverse engineer, decompile, or disassemble the Software unless permitted by law.
• Rent, lease, lend, or resell the Software.
• Remove proprietary notices, signatures, watermarks, or technical safeguards.
• Use the Software to compete against RescuePC Repairs or for unlawful purposes.

4. Data Usage & Connectivity

4.1 License Validation (Mandatory)

The Software requires an internet connection to validate your license key upon activation and periodically thereafter. During validation, the Software transmits only necessary data to RescuePC servers, including: (i) the license key, (ii) a hashed hardware identifier (Machine ID) to prevent unauthorized sharing, and (iii) the Software version number. No personal files, browsing history, or student records are transmitted during this process.

4.2 Diagnostic Data (Limited)

The Software may collect anonymized diagnostic information (e.g., crash reports, error codes) to assist in bug fixing and product improvement ("Diagnostic Data"). This data is stripped of personally identifiable information (PII) before transmission. You acknowledge that RescuePC Repairs utilizes third-party error tracking services (e.g., Sentry) strictly for this purpose.

4.3 Updates

The Software automatically checks for updates by querying RescuePC servers. You may control the installation of these updates, but you acknowledge that failing to update may leave the Software vulnerable or incompatible with current operating systems.

5. System Modifications & Risk Acknowledgment

You acknowledge that the Software is designed to perform administrative-level modifications to the operating system, including but not limited to: registry editing, service configuration, file deletion, and network stack resets. While these operations are intended to repair system functionality, they carry inherent risks. You agree to maintain current backups of all critical data prior to executing any repair functions. RescuePC is not liable for data loss or system instability resulting from the application of these repairs.

6. Digital Signatures & Verification

• The Toolkit includes cryptographic signatures and license verification routines.
• Tampering with or bypassing these controls voids the license immediately.

7. Warranty Disclaimer

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. RESCUEPC REPAIRS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

IN NO EVENT SHALL RESCUEPC REPAIRS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Termination

• The Agreement terminates immediately if you violate any clause.
• Upon termination you must stop using the Toolkit and destroy all copies.

10. Governing Law

This Agreement is governed by U.S. law, without regard to conflict-of-law principles. Any unenforceable provision shall be reformed to the minimum extent necessary.

11. Entire Agreement

This document represents the entire agreement between you and RescuePC Repairs concerning the Toolkit and supersedes prior proposals or discussions.
